Access to the Point Topic website, use of material and payment information

Part 1 General Terms and Conditions

The following terms and conditions apply to all subscribers and visitors to the Point Topic web site. Terms and conditions which differ according to the Subscription Option chosen are set out in Part 2 below.

Copyright Information

All the material on the Point Topic web site is the copyright of Point Topic Ltd unless otherwise stated. All rights are reserved by Point Topic Ltd. Reproduction of the material in any form without explicit permission is forbidden.

Reproduction of Open Pages

The Open Pages of the Point Topic website are those parts of the website which are accessible free of charge to any visitor to the website. Any website user is hereby granted permission to make one copy of any material on the Open Pages of the Point Topic website for research purposes provided that the copies or the material are credited to Point Topic and are not offered for sale or otherwise used for gain.

Users who wish to reproduce material from the Open Pages for gain, for example in a publication or on another website, should apply to the Point Topic webmaster for permission.

Reproduction of and access to Subscriber Sections

The Subscriber Sections of the Point Topic website are those parts of the website which are accessible only to persons or organisations registered as subscribers to them. Registered Subscribers are entitled to access and download any of the Subscriber Sections covered by their subscription as frequently as they wish. Each person authorised to access any of the Subscriber Sections may hold one electronic copy of any document from the Subscriber Section concerned at one time, plus any additional backup copies produced by their normal operations, on their own computer system.

Subscribers who wish to reproduce multiple copies of material from the Subscriber Sections for any reason should apply to the Point Topic webmaster for permission.

Reproduction of PDF files

The one-off purchase of a PDF file version of one-off reports published by Point Topic, such as the DSL Worldwide Directory, covers a single user holding one copy of the relevant file on their system, and one print-out. Purchasers who wish to reproduce multiple copies of the Directory for any reason should apply to the Point Topic webmaster for permission.

Purchasers of a PDF file version are licensed to reproduce limited tables and data from the PDF file so long as they are attributed to Point Topic. Purchasers wishing to reproduce more than 10% of the data should apply to the Point Topic webmaster for permission.

Reproduction of bound hard copies

The one-off purchase of a bound hard copy of any report published by Point Topic, such as the DSL Worldwide Directory, covers a single user holding one single copy. The customer is not thereby authorised to photocopy or otherwise reproduce this document. Purchasers who wish to reproduce multiple copies of the Directory for any reason should apply to the Point Topic webmaster for permission.


Part 2 Terms and Conditions for Subscription Options

Subscription options available

At present (July 2008) Point Topic offers four primary subscription services with two service level options. The subscription services are The Operator Source, Global Broadband Statistics, UK Plus and Broadband Money Makers.

The services are separate subscriptions. Subscription to one does not allow users access to the other. Each must be purchased seperately.

The two service level options and the access they provide are as follows:

Corporate/Global Subscription

Provides online access for an unlimited number of named users in the subscribing organisation. The named users can work in separate countries but must work for the subscribing organisation. The subscription purchaser will be given instructions for adding new users to the subscription. Point Topic reserves the right to charge an administration fee if we are asked to add more than 25 users to the subscription.  User organisations can add as many users as they wish themselves using the site functionality without incurring any fees.

Up to Five User Full Service Subscription

Provides online access for up to five named users in the subscribing organisation. The 5 named users can work in separate countries but must work for the subscribing organisation. Only the 5 named users are permitted to download, access or use information from the subscription service. Point Topic reserves the right to cancel subscriptions where there is evidence of copyright abuse.

 

Subscription facilities

Each subscription includes telephone or email customer support for issues to do with access to the website in UK office hours. Point Topic also welcomes contact from subscribers for enquiries, discussion or advice. But subscriptions do not include the right to such access, and Point Topic reserves the right to charge for access to its analyst staff.

Subscriber Section files may not be accessed by more users than are allowed in the terms of the subscription. They must not be made available electronically or in hard copy to anybody who is not an employee of the Subscriber organisation or its subsidiaries.

Employees of the Subscriber organisation and its subsidiaries can print out Subscriber Section files as hard copy as required for their own use, whether from the Point Topic web site or from a file held on the Subscriber's computer systems. These hard copies, or hard copy versions of Subscriber Sections supplied by Point Topic, must not be further reproduced by photocopying or any other means without explicit permission from Point Topic Ltd.

Unless otherwise arranged and confirmed with Point Topic, a subscription service lasts for 12 calendar months from the date when the subscription order is received, and subsequent renewals start and terminate on the same dates.


Part 3 Terms and conditions of payment and delivery

Point Topic currently takes payment by bank transfer, cheque or credit card (Mastercard or Visa).  Full payment details are sent with an invoice on receipt of an order. The standard payment terms are 30 days.  Accounts are activated on receipt of payment. Order confirmation will be emailed as soon as payments are authorised.

Once the account is activated the named user/s are able to access all reports, papers and services (in the products subscribed to) online immediately.  Reports are available for download as plain HTML, MS Word and/or MS Excel files.  Outputs from the database products are available as MS Excel or CSV files.  An account is typically active for 12 months from date of payment.

Customers can cancel an order within 30 days of order and receive a full refund subject to the following terms and conditions:
  1. The customer must delete or destroy all print and/or digital copies and versions of any Point Topic data downloaded from the service.
  2. The customer must confirm that this process has been completed and that no Point Topic data, analysis or information from the subscription services will be used for any purpose after the cancellation.
  3. Refunds are not available if the customer has previously used/reviewed the service.
  4. Point Topic reserves the right to refuse a refund if in it is not satisfied that the steps above will or can be carried out by the customer.
